Leasing Terms

General Terms of Lease

The provisions of this agreement shall be in effect commencing on _______________________________ and due the ______ day of every month until livestock are returned.

No Right To Sublease: The livestock owner does not convey to the lessee the right to lease or sublet or assign the lease to any person or persons whomsoever.

The lessee will care for the livestock using good management practices for livestock maintenance, including but not limited to, feeding, watering and herd health. Any cattle returned needing medical care or unable to perform it’s physical duty will be billed to lessee and due immediately. Including but not limited too; crippled, damaged eyes, broken horns, etc.

Termination. You can terminate this Agreement at any time by returning the livestock to us or arranging with us for its return and paying all amounts due to us on the date of termination. If you terminate, you agree to return the livestock to us in the same condition it was in on this date. If you terminate, you will still owe us any past-due rental payments, and you will continue to owe rentuntil you return the livestock to us. We can terminate this Agreement if you breach any of its terms.

Our Rights to Take Possession. If you do not renew this Agreement or if you breach this Agreement, we have the right to the immediate possession of our livestock, subject to your reinstatement rights. If we incur costs and expenses to enforce the terms of this Agreement because of a breach by you or by your agents, servants, or employees, including the repossession of our livestock, you will be liable for all of our reasonable costs and expenses, including reasonable attorney's fees and court costs, if permitted by state law.

Access Easement. For as long as you are in possession of our livestock, you grant us an access easement at the address where the livestock is located so that we can retrieve if at default. You must not place any obstructions that would keep us or our agents from removing the livestock if you do not renew this Agreement, and you agree that you will not hold us or our agents responsible for any damages or losses if we have to remove any obstructions to recover our livestock. You also grant us the right to inspect the Property at all reasonable times.

Any livestock that is deemed unusable, crippled or die in the possession of the lessee, the lessee will pay the full valued declared in the amount listed in section above.

Transportation of the livestock is the sole responsibility of the lessee.

In the event of default, the livestock owner can declare the unpaid amount due immediately. If livestock is not returned and monthly bill amount is 10 days past due, the full declared value amount of each livestock in the lessee possession is due in full immediately.

Entire Agreement. This Agreement sets forth the entire agreement between you and us and may not be changed except inwriting signed by both parties.

Binding effect. This Agreement is binding upon both parties and their heirs, successors, and assigns.
